Finally Rayamazhi has been arrested on refugee related case
Kathmandu. CPN-UML's suspended secretary and member of the House of Representatives Top Bahadur Rayamazhi was arrested on Sunday. He was arrested on charges of organized fraud by making Nepalis fake Bhutanese refugees and bringing them to America. The question has been raised as to what will happen to Rayamazhi, who was elected from Arghakhanchi in the House of Representatives elections held in November 2079.
In Rule 248 of the House of Representatives Rules 2079, there is a provision that in accordance with the restrictive phrase of Article 103, Clause 6 of the Constitution, if information is received that a member has been arrested, that information must be given to the House immediately. When the meeting is not held, there is a provision to post a notice about it and make it public.
In sub-rule 3, 'According to the prevailing law, if an indictment has been filed in a criminal case punishable by imprisonment for three years or more or showing moral turpitude, and if he is in custody for pre-trial detention, for the duration of such detention, or if he is absconding without being in such detention, in accordance with the court's order, he shall be As a member, he will not be able to do any work or receive any rights or immunity and he will remain suspended during such period and his remuneration, services and facilities will also be suspended.
Similarly, in sub-rule 4, if a member has been sentenced to imprisonment by a court decision in a criminal case, for the duration of such imprisonment, or if a member is serving a prison sentence in a criminal case, for the entire period, or if a member has yet to pay imprisonment, or for the entire period until the imprisonment is not paid after being arrested. There is a provision that automatic suspension will be considered.
Also, if any member arrested according to sub-rule 3 is acquitted or released from prison, there is a provision that the Speaker should immediately inform the House of the suspension release notice.
